Terms of Use

This page is a translation for your information. Only the German version is legally binding. Read the German original

1. Scope

These Terms of Use govern the use of the mobile application “Screw It Up!” (hereinafter “App”), which is provided by Christian Zippel, Ruibrunnenstr. 2, 75242 Neuhausen, Deutschland (hereinafter “Provider”). By installing or using the App, you accept these terms.

2. Licence and scope of use

The Provider grants you a perpetual, simple, non-exclusive and non-transferable licence to use the App on end devices you are authorised to use, exclusively for private, non-commercial purposes.

Reproduction, distribution, modification, decompilation, reverse engineering or any other alteration of the App and its components is only permitted insofar as this is expressly allowed by mandatory law (in particular § 69d and § 69e UrhG, the German Copyright Act).

3. In-app purchases

The App offers paid content (e.g. virtual currencies, power-ups, ad removal) as so-called in-app purchases. These are processed via the Apple App Store or the Google Play Store. The payment and cancellation terms of the respective store apply.

Virtual content (e.g. gold coins, power-ups) consists of non-transferable digital licences, has no monetary value outside the App and cannot be exchanged for cash or other assets. Ad removal (“NoAds”) is a one-time licence tied to the device or account.

Refund requests must be addressed directly to Apple or Google. The Provider has no influence on the platforms’ refund decisions.

4. Advertising

The App is partly financed by advertising from the Unity Ads service (Unity Technologies S.F., 116 New Montgomery Street, Suite 200, San Francisco, CA 94105, USA). There are three ad formats:

You can permanently deactivate banner and full-screen ads by buying the “Remove Ads” in-app purchase. Rewarded video ads then remain available as a voluntary option.

The data processed in this context is described in detail in our Privacy Policy.

5. Prohibited use

You undertake not to misuse the App. The following in particular are prohibited:

In the event of a violation, the Provider reserves the right to revoke the licence and to prohibit further access, insofar as this is technically possible.

6. Availability and updates

The Provider strives to ensure the highest possible availability of the App but does not guarantee uninterrupted availability. Updates may be provided via the App Store or Google Play and may contain bug fixes, security improvements or new features. Earlier versions of the App may no longer be supported after an update.

7. Data loss

Game progress is stored locally on the end device; cloud synchronisation does not currently take place. The Provider does not guarantee the permanent availability or recoverability of game progress in the event of loss of the device, a change of device or uninstallation of the App.

8. Liability

The Provider is liable in accordance with the statutory provisions for damage resulting from injury to life, body or health that is based on a negligent or intentional breach of duty, and for other damage that is based on a grossly negligent or intentional breach of duty.

In cases of slight negligence, the Provider is liable only for the breach of essential contractual obligations (cardinal obligations), and then only up to the amount of the typical damage foreseeable at the time the contract was concluded.

Any further liability, in particular for loss of profit, indirect damage, data loss or consequential damage, is excluded to the extent permitted by law.

9. Data protection

Information on the processing of personal data can be found in our Privacy Policy. It forms part of these Terms of Use.

10. Changes to these terms

The Provider may amend these Terms of Use insofar as the amendment is necessary and the interests of the user are appropriately taken into account. The current version can always be accessed at this URL. Material changes will be communicated in the App and/or via an update notice.

11. Applicable law and place of jurisdiction

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, mandatory consumer protection provisions of the state in which they reside remain unaffected. The place of jurisdiction for disputes with merchants, legal entities under public law or special funds under public law is, where permissible, the Provider’s place of business.

12. Severability clause

Should any provision of these terms be or become invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a valid provision that comes closest to the economic purpose of the invalid provision.
